Terms and Conditions for DSE MTP
1.0 Introduction
The Dar es Salaam Stock Exchange Mobile Trading Platform ("DSE MTP") has set terms and conditions ("Terms") for governing the use of our services ("Services"). By accessing or using the MTP, you agree to comply with and be bound by these Terms.
2.0 Eligibility
You must be at least 18 years old and legally capable of entering into binding contracts to use this Platform. By using our Services, you represent and warrant that you meet these requirements.
3.0 Account Registration
3.1 You must register for an account to access certain features of the Platform. You agree to provide accurate and complete information during the registration process.
3.2 You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
4.0 Use of the Platform
4.1 You agree to use the Platform only for lawful purposes and in accordance with these Terms.
4.2 You are prohibited from:
- Using the Platform for any illegal activity.
- Using automated systems or software to extract data from the Platform.
- Interfering with the security or integrity of the Platform.
5.0 Investment Advice
5.1 The Platform does not provide financial, legal, or tax advice. Any information provided on the Platform is for informational purposes only and should not be considered as professional advice.
5.2 You should consult with a qualified financial advisor i.e. LDM before making any investment decisions.
6.0 User Conduct
6.1 You agree not to:
- Post or transmit any content that is harmful, offensive, or otherwise objectionable.
- Engage in any activity that could damage or disrupt the Platform.
6.2 We reserve the right to remove any content that violates these Terms or is otherwise inappropriate.
7.0 Fees and Payments
7.1 Certain features of the Platform may require payment of fees. You agree to pay all applicable fees as described on the Platform.
7.2 All fees are non-refundable unless otherwise stated.
8.0 Privacy Policy
Your use of the Platform is also governed by our Privacy Policy, which is available in the DSE website, www.dse.co.tz. Please review our Privacy Policy to understand our practices.
9.0 Intellectual Property
9.1 The Platform and its content are protected by intellectual property laws. You agree not to reproduce, distribute, or create derivative works based on the Platform without our express written permission.
9.2 You retain ownership of any content you submit to the Platform, but you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, and distribute such content.
10.0 Limitation of Liability
10.1 The Platform is provided on an "as is" and "as available" basis. We make no warranties or representations about the accuracy or completeness of the content on the Platform.
10.2 We are not liable for any indirect, incidental, or consequential damages arising out of or in connection with your use of the Platform.
11.0 Indemnification
You agree to indemnify and hold harmless DSE MTP, its affiliates, and their respective officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising out of your use of the Platform or your violation of these Terms.
12.0 Changes to These Terms
We may modify these Terms at any time and will notify you of any changes by posting the new Terms on the Platform. Your continued use of the Platform after such changes will constitute your acceptance of the new Terms.
13.0 Termination
We may lock, terminate or suspend your account and access to the Platform at any time where Exchange determines that the particular circumstances warrants so, by giving prior notice of the reasons for termination, including but not limited to:
- Breach of these Terms,
- Breach of DSE & CSDR Rules, 2022
- Inappropriate use of the platform i.e. multiple entry of wrong credentials,
- Illegal activities associated with the use of the platform i.e. money laundering.
- Legal requirements
- Force Majeure
- Infringement of the Intellectual Property rights of the DSE MTP by the Customer.
14.0 Force Majeure
14.1 Neither you nor the platform will be responsible for non-compliance with these Terms to the extent that we are prevented from doing so by issues outside our control (force majeure).
14.2 If a party experiences force majeure which prevents them from complying with one of their obligations, they need to notify the other party.
15.0 Governing Law
These Terms are governed by and construed in accordance with the DSE Rules, Regulations and laws of Tanzania, without regard to its conflict of law principles.
